Grundsätzliches Jaenicke-Njoya GmbH (im Nachfolgenden tribalartforum genannt) ist Betreiber einer Auktionsplattform mit besonderer Ausrichtung auf Außer Europäischer Kunst. Die Betreiber sind bemüht dieses Profil aufrechtzuerhalten und zu schärfen. Die Plattform wird ausschließlich registrierten Mitgliedern („Nutzer“) im Wege eines Nutzungsvertrages zugänglich gemacht. Die nachfolgenden Bedingungen beschreiben unter welchen Vorraussetzungen auf diese Plattform selbständig Waren und/oder    Dienstleistungen versteigert und/oder ersteigert sowie alle zu dieser Domain gehörenden Subdomains genutzt werden können. tribalartforum bietet selbst keine Waren oder Dienstleistungen an. Ein Vertrag über die angebotenen Waren und/oder Dienstleistungen kommt ausschließlich zwischen den Nutzern zustande. tribalartforum haftet nicht für die Qualität, Sicherheit oder Rechtmäßigkeit der angebotenen Waren oder Dienstleistungen, für die Wahrheit und Richtigkeit der Angebote oder die Berechtigung der Verkäufer, die Waren oder Dienstleistungen zu verkaufen bzw. die Fähigkeit der Käufer, diese zu kaufen. tribalartforum distanziert sich von allen Inhalten der Webseite. Dies gilt auch für alle bei tribalartforum enthaltenen Links zu externen Seiten und alle Inhalte dieser Seiten, zu denen diese Links führen. Allgemeine Nutzungsbedingungen Anmeldung Die Nutzung der Auktionsplattform ist nur nach vorheriger Anmeldung möglich. Mit der Anmeldung kommt ein Vertrag über die Nutzung der Plattform mit dem Betreiber zustande. Zur Anmeldung zugelassen sind ausschließlich unbeschränkt geschäftsfähige natürliche und juristische Personen. Bei der Anmeldung sind die Vertretungsverhältnisse zu wahren. Zu Zwecken der Anmeldung sind die abgefragten Daten vollständig und korrekt anzugeben. Es obliegt dem Nutzer, den Datensatz im Falle von Änderungen unverzüglich zu aktualisieren. Die Daten werden im Sinne der geltenden Datenschutzbestimmungen behandelt. Der Nutzer wählt bei der Anmeldung einen Mitgliedsnamen und ein Passwort. Der Mitgliedsname darf nicht Rechte Dritter, insbesondere keine Namens- und Markenrechte, verletzen und nicht gegen die guten Sitten verstoßen. Das Passwort ist geheim zu halten. Dem Nutzer steht es frei, sich unter mehreren Namen gleichzeitig zu registrieren. Dies gilt nur soweit, wie dies nicht im Rahmen des Bewertungssystems oder der Versteigerung selbst missbraucht wird (siehe hierzu B.V. bzw. C.III.4.). Die Anmeldung ist kostenfrei. Umfang der Nutzung Der Betreiber stellt den Nutzern eine in Kategorien unterteilte online-Aktionsplattform zur Verfügung. Zur Abwicklung der zwischen den Nutzern geschlossenen Verträge teilt der Betreiber nach vollzogener Versteigerung dem Verkäufer und dem Käufer per Email die jeweils notwendigen Daten zur Kontaktaufnahme mit der Gegenseite mit. Darüber hinaus behält sich der Betreiber vor, dem Verkäufer, dem Höchstbietenden und gegebenenfalls auch dem Zweithöchstbietenden auch den Namen und die Anschrift des jeweils anderen Handelspartners bzw. potentiellen Handelspartners mitzuteilen. Sollte durch einen eventuellen Fehler im Programm, durch einen Serverausfall, Kapazitätsüberlastung oder sonstige nicht vorhersehbaren Umstände dieses Angebot vorübergehend nicht verfügbar sein oder dadurch Daten verloren gehen, können hieraus keinerlei Ansprüche gegen den Betreiber entstehen. Diese Plattform und wird ohne jegliche Zusicherung in Bezug auf Verfügbarkeit und Qualität gewährt. Der Betreiber behält sich das Recht vor, jederzeit und ohne Nennung von Gründen die Webseiten zu verändern. Sofern Wartungs- oder Änderungsarbeiten den laufenden Betrieb beeinträchtigen werden, teilt der Betreiber dies rechtzeitig mit. Gebühren Für die Nutzung der online-Auktionsplattform fallen pro erfolgreich getätigten Geschäfts Kosten in Gestalt einer Gebühr an. Die jeweilige Höhe sind der jeweils aktuellen Gebührenordnung (Darstellung als Link) zu entnehmen. Bewertungssystem Im Interesse der Transparenz, Vertrauenswürdigkeit und Sicherheit der Geschäftsabwicklung, bietet Betreiber ein Bewertungssystem an, in dem Verkäufer und Käufer sich nach der Durchführung des Kaufvertrages gegenseitig bewerten können. Dies soll anderen Nutzern helfen die jeweilige Gegenseite einzuschätzen. Diese Bewertungen werden vom Betreiber verfolgt aber nicht auf ihre Richtigkeit überprüft. Erreicht ein Mitglied einen Bewertungsstand von -3 (minus drei), wird der Nutzungsvertrag sofort fristlos gekündigt und das Mitglied wird von der Nutzung dieser Auktionsplattform ausgeschlossen. Jede missbräuchliche Verwertung des Bewertungssystems ist untersagt. Die gilt insbesondere, für die Abgabe wissentlich falscher Bewertungen sowie für den Fall, dass Bewertungen über sich selbst abgegeben werden (z.B. durch Nutzung eines zweien Mitgliednamens) oder über Dritte veranlasst werden. Der Betreiber ist dazu berechtigt, von Nutzern manipulierte Bewertungseinträge nach Kenntniserlangung zu berichtigen und / oder zu entfernen. Kommunikation Sämtliche Erklärungen, die eine Partei der anderen im Zusammenhang mit diesen Nutzungsbedingungen übermittelt, müssen in Schriftform an (Postanschrift) oder via Email an (Email Adresse) erfolgen. Maßgeblich ist die dem Betreiber bei Abschluss des Nutzungsvertrages zur Verfügung gestellte bzw. anschließend mitgeteilte Anschrift. Der Betreiber behält sich das Recht vor, die eigene Email-Adresse nach eigenem Ermessen zu ändern. Die Nutzer werden über die geänderte Email-Adresse informiert. Besondere Handelsgrundsätze Allgemeines Die Nutzer sind angehalten nur Waren oder Dienstleistungen in die Plattform einzustellen, die dem Profil und der Ausrichtung von tribalartforum entsprechen. Sie sind weiter angehalten die Angebote in die richtige Kategorie einzustellen. Die Nutzer sind verpflichtet, sämtliche geltenden Gesetze, Verordnungen und sonstigen staatlichen Rechtsetzungsakte zu befolgen, die auf die Nutzung der Plattform, auf ihre Gebote und Auflistungen sowie auf den Kauf und Verkauf von Waren oder Dienstleistungen über die Plattform anwendbar sind. Insbesondere müssen alle zur Verfügung gestellten Informationen der Wahrheit entsprechen und dürfen weder Gesetze noch Rechte Dritter verletzen. Der Betreiber überprüft die Informationen nicht und kann diesbezüglich nicht haftbar gemacht werden. Ferner ist es untersagt, Waren oder Dienstleistungen anzubieten, die unter die Liste der verbotenen Waren oder Dienstleistungen (siehe C.IV.) fallen. Weiter ist es untersagt Waren anzubieten, deren Veräußerung der notariellen Beurkundung bedarf. Vertragsschluss im Wege der online-Auktion („secret-bid-option“) Mit Freischaltung der vom Anbieter eingestellten Angebotsseite durch tribalartforum wird ein verbindliches Angebot zum Abschluss eines Kaufvertrages abgegeben. Dieses Angebot richtet sich an den Bieter, der während der Laufzeit der Online-Auktion das höchste Gebot abgibt und etwaige zusätzlich festgelegte Bedingungen (z.B. Angebot nur an Bieter ab einer gewissen Bewertungspunktzahl) erfüllt. Der Startpreis beträgt mindestens 1,00 Euro. Das Gebot eines Bieters erlischt, wenn ein neuer Bieter während der Laufzeit der Online-Auktion ein höheres Gebot abgegeben hat. Mit dem Ende der jeweils bestimmten Laufzeit einer Online-Auktion kommt mit dem Bieter, der das höchste Angebot abgegeben hat, ein Vertrag nach deutschem Recht zustande. Ein Vertrag kommt nicht zustande, wenn der Anbieter einen Mindestpreis bestimmt hat und das höchste Gebot unter diesem Preis liegt. Der Anbieter hat die Möglichkeit bei Einstellung des Angebots einen Mindestpreis offen oder verdeckt anzugeben, zu dem er zu verkaufen bereit ist. Offene Mindestpreise werrden als "minimum bid" angegeben, verdeckte Mindestpreise unter den Namen, " fetcher, adamaoua, , africoll, barrings, finnegans, flitchlord, rusty, philipipotto, ernst2, fames, segouba." Dieser Preis ist nur für den Anbieter sichtbar. Andere Bieter oder Anbieter können den Mindestpreis nicht sehen (secret-bid-option). Solange der Mindestpreis nicht erreicht wurde, erscheint auf der Artikelseite des Anbieters der Hinweis "Mindestpreis nicht erreicht". Wird der Mindestpreis erreicht oder überboten, erscheint der Hinweis "Mindestpreis erreicht". Die Erreichung des Mindestpreises beendet die Auktion nicht. Bieter können bis zum Ende der Laufzeit Gebote abgeben. Am Ende der Laufzeit kommt ein Vertrag mit demjenigen Bieter zustande, der das höchste, über dem Mindestpreis liegende Gebot abgegeben hat. Pflichten des Veräußerers Allgemeines Der Veräußerer hat sein Angebot in die entsprechende Kategorie einzustellen sowie richtig und vollständig zu beschreiben. Hierbei muss er alle für die Kaufentscheidung wesentlichen Eigenschaften und Merkmale sowie Fehler, die den Wert der angebotenen Ware nicht nur unerheblich mindern, wahrheitsgemäß angeben. Zudem muss er die Nutzer über das Eigentum an dem angebotenen Artikel, seine Verfügungsbefugnis und Lieferfähigkeit, die Angebotsdauer sowie die Einzelheiten der Zahlung und Lieferung bzw. Erfüllung vollständig informieren. Wenn mit dem "Mengen Lister" mehrfache Auktionen eingestellt werden, müssen alle angebotenen Gegenstände gleich sein (Größe, Farbe, Muster, Modell etc.). Keinesfalls dürfen mehr als 10 gleiche Gegenstände parallel angeboten werden. Darbietung der Waren und Dienstleistungen Der Veräußerer kann seine Waren und Dienstleistungen mit Worten, Zeichnungen oder Bildern beschreiben oder auf dieser Auktionsplattform einen Link zu Texten, Zeichnungen oder Bildern zur Verfügung stellen, die den angebotenen Waren und Dienstleistungen beschreiben. Die Beschreibung der Ware sowie Zeichnungen und Bilder dürfen keine Werbung für andere als die angebotene Ware enthalten, insbesondere nicht durch Verweisung mittels Links auf die eigene Homepage. Sie dürfen keine Gesetze oder Verordnungen verletzen (insbesondere strafrechtliche, urheberrechtliche, verbraucherschutzrechtliche oder wettbewerbsrechtliche Regelungen, Diskriminierungsverbote etc.). Kontaktaufnahme mit Bietern Solange ein anderer Veräußerer einen Artikel auf dieser Plattform anbietet, dürfen andere (potentielle) Veräußerer den bietenden Käufern keine Emails senden oder sonst in Kontakt treten, und ähnliche oder gleiche Gegenstände zu irgendeinem Preis anbieten. Sofern andere (potentielle) Veräußerer in dem das Angebot betreffenden Bereich gewerblich tätig sind, ist Ihnen dies auch für eine angemessene Frist nach Ablauf der Auktion nicht erlaubt. 4. Informationspflichten Der Veräußerer hat alle gesetzlichen Informationspflichen zu erfüllen. Die Erfüllung dieser Informationspflichten ist allein Sache des Veräußerers. Insbesondere hat er auch eine eventuell zusätzlich anfallende Mehrwertsteuer oder sonstige Preisbestandteile anzugeben. Ferner muss er die Nutzer über zusätzlich anfallende Liefer- und Versandkosten informieren. Weitergehende Informationspflichten des Verkäufers gegenüber Verbrauchern die sich aus dem Fernabsatzgesetz, dem Verbraucherkreditgesetz oder anderen gesetzlichen Bestimmungen ergeben können, bleiben unberührt. Werden auf dieser Plattform Waren und / oder Dienstleistungen an Verbraucher in Ausübung einer gewerblichen oder selbstständigen beruflichen Tätigkeit veräußert, muss er den Nutzern mit der Artikelbeschreibung auch seinen Namen und / oder seine Firma sowie seine Anschrift mitteilen. Manipulation des Ersteigerungsvorgangs Dem Veräußerer ist es untersagt, manipulativ auf den Ersteigerungsvorgang einzuwirken. Insbesondere ist es untersagt, über einen weiteren Mitgliedsnamen selbst Gebote auf die von ihm eingestellten Angebote abzugeben. Ferner darf der Ersteigerungsvorgang nicht durch die kollusive Einschaltung eines Dritten beeinflusst werden. Von keiner Seite darf darauf hingewirkt werden, dass die Grundsätze der Gebührenordnung (Darstellung als Link) umgangen werden. Liste verbotener Waren und Dienstleistungen Es ist verboten, Waren und Dienstleistungen anzubieten, die nicht dem Profil und der Ausrichtung dieser Auktionsplattform entsprechen, deren Angebot oder Verkauf gegen gesetzliche Vorschriften oder gegen die guten Sitten verstößt. Insbesondere dürfen folgende Waren und Dienstleistungen nicht angeboten werden: - Gestohlene Waren, - Waren oder Dienstleistungen, die Urheberrechte, Patente, Marken, Betriebsgeheimnisse oder andere Schutzrechte, Persönlichkeitsrechte oder Datenschutzrechte Dritter verletzen, - Illegale Software (dieser Verstoß wird umgehend dem Hersteller dieser Software gemeldet der dann weitere Schritte gegen den Einsteller der Auktion einleiten wird !!!), - Jugendgefährdende Schriften, Videos und Abbildungen, - Wertpapiere. Eingriffsrecht der Betreiber Der Betreiber behält sich vor, die angebotenen Artikel einer anderen als der vom Anbieter ausgewählten Angebotskategorie zuzuordnen. Der Betreiber ist berechtigt, nach eigenem Ermessen sämtliche seiner Ansicht nach erforderlichen oder angemessenen Maßnahmen zu ergreifen, wenn die Gefahr besteht, dass er für die eingestellten Informationen haften muss, dass diese (ganz oder teilweise) den Verlust der Dienstleistungen unserer Internet Service Provider oder anderer Lieferanten bewirken könnten oder wenn die Informationen gegen diese Nutzungsbedingungen verstoßen. Der Betreiber ist dazu berechtigt, von Nutzern manipulierte Bewertungseinträge nach Kenntniserlangung zu berichtigen und / oder zu entfernen. Der Betreiber ist insbesondere auch dazu berechtigt, Angebote umgehend zu sperren, die der Liste der verbotenen Waren und Dienstleistungen zuzuordnen sind. Dies gilt ausdrücklich auch für Angebote, die dem Profil und der Ausrichtung der Plattform zuwiderlaufen. Systemintegration Die Nutzer sind nicht berechtigt, Mechanismen, Software oder sonstige Routines zu verwenden, die das Funktionieren der Website des Betreibers oder eines Verkaufs gegen Höchstgebot, der auf unseren Webseiten durchgeführt wird, stören bzw. dies zu versuchen. Sie dürfen keine Maßnahmen ergreifen, die eine unzumutbare oder übermäßige Belastung unserer Infrastruktur zur Folge haben. Das Passwort darf weder veröffentlicht noch anderen mitgeteilt werden oder unbefugt für andere Zwecke verwendet werden. Die Inhalte der tribalartforum-Website dürfen ohne vorherige schriftliche oder via Email erteilte Zustimmung des Betreibers und etwaigen anderen Rechteinhabern weder kopiert, verbreitet noch in sonstiger Weise genutzt oder vervielfältigt werden. Änderungsvorbehalt Der Betreiber behält sich vor, diese Nutzungsbedingungen jederzeit und ohne Nennung von Gründen zu ändern. Die geänderten Bedingungen werden dem Nutzer per Email rechtzeitig zugesandt. Kündigungsrecht Kündigungsrecht des Nutzers Der Nutzer ist berechtigt den Nutzungsvertrag jederzeit (z.B. nach einer Änderung der Nutzungsbedingungen) ohne Angabe von Gründen zu kündigen. Für die Kündigungserklärung genügt eine schriftliche Mitteilung an (Postanschrift) oder (Email) Kündigungsrecht des Betreibers Ordentliches Kündigungsrecht Der Betreiber ist berechtigt den Nutzungsvertrag jederzeit mit einer Frist von vierzehn Tagen zum Monatsende zu kündigen. Außerordentliches Kündigungsrecht Ohne Einhaltung jeder Frist kann der Betreiben kündigen, wenn ein dringender Grund vorliegt. In diesem Fall sperrt der Betreiber umgehend alle Angebote und Gebote des Nutzers und löscht alle auf ihn registrierten Mitgliedskonten. Eine erneute Anmeldung ist ihm untersagt. Dringende Gründe sind insbesondere: - ein Verstoß gegen die Liste verbotener Waren und Dienstleistungen, - ein gehäuftes Anbieten von Waren und Dienstleistungen die dem Profil und der Ausrichtung der Plattform zuwiderlaufen, - eine Manipulation des Ersteigerungsvorgangs, - eine Manipulation des Bewertungssystems, - das Erreichen eines Bewertungsstandes von -3, - die Gefährdung der Systemintegrität, - sonstige erhebliche oder gehäufte Verstöße gegen diese Nutzungsbedingungen. Haftungsbeschränkung Der Betreiber haftet nur für Vorsatz und grobe Fahrlässigkeit, im Falle der Verletzung wesentlicher Vertragspflichten jedoch für jedes schuldhafte Verhalten seiner Mitarbeiter. Der Betreiber haftet nicht für mittelbare Schäden, insbesondere nicht für entgangenen Gewinn, es sei denn, diese Schäden beruhen auf Vorsatz von Mitarbeitern oder Vorsatz und grober Fahrlässigkeit von gesetzlichen Vertretern und leitenden Angestellten des Betreibers. Außer bei Vorsatz von Mitarbeitern und Vorsatz und grober Fahrlässigkeit von gesetzlichen Vertretern und leitenden Angestellten ist die Haftung der Höhe nach auf die bei Vertragsschluss typischerweise vorhersehbaren Schäden begrenzt. Er übernimmt diesbezüglich auch die Kosten der Rechtsverteidigung des Betreibers einschließlich sämtlicher Gerichts- und Anwaltskosten. Anwendbares Recht, Gerichtsstand, Salvatorische Klausel Diese Nutzungsbedingungen unterliegen dem deutschen Recht. Sofern es sich bei dem Nutzer um einen Kaufmann gemäß dem Handelsgesetzbuch, ein öffentlich rechtliches Sondervermögen oder eine juristische Person des öffentlichen Rechtes handelt, wird Straubing als ausschließlicher Gerichtsstand für alle Streitigkeiten, die aus diesen Nutzungsbedingungen entstehen, vereinbart. Sofern eine Bestimmung dieser Nutzungsbedingungen unwirksam ist, bleiben die übrigen Bestimmungen davon unberührt. Die unwirksame Bestimmung gilt als durch eine solche ersetzt, die dem Sinn und Zweck der unwirksamen Bestimmung in rechtswirksamer Weise wirtschaftlich am nächsten kommt. Gleiches gilt für eventuelle Regelungslücken.

The Operators wish to maintain, indeed strengthen this profile. The platform is made accessible exclusively to registered members (“Users”) in the form of a utilisation agreement. The terms and conditions below describe the requirements for independently auctioning and/or purchasing goods and/or services on this platform and for using any and all subdomains which belong to this domain. tribalartforum itself does not offer any goods or services. A contract regarding the offered goods and/or services is concluded exclusively between the Users. tribalartforum is not liable for the quality, security or legality of the offered goods or services, for the truth and correctness of the offers or for the authorisation of the sellers to sell the goods or services or the capability of the buyers to purchase same. tribalartforum disclaims any responsibility for any and all content on the website. This disclaimer also applies to any links to external sites found at tribalartforum and to any and all content on the sites to which the links lead. General Terms and Conditions of Utilisation Registration The auction platform may not be utilised until registration has been completed. The registration is concurrent with the conclusion of a contract with the Operator regarding the utilisation of the platform. Solely natural and legal persons of unlimited legal capacity are permitted to register. Any relationships of representation shall be maintained during registration. The data which is requested during the registration process shall be given completely and correctly. It is the responsibility of the User to update the data records without delay in the event of any changes. The data will be treated in conformity with applica-ble data protection regulations. The User selects a member name and password during the registration process. The member name may not infringe upon any third-party rights, in particular any rights to names or trademarks, and may not be contra bonos mores. The password must be kept secret. The User is free to register under more than one name at the same time. However, multiple registrations may not be used to facilitate misuse of the rating system or of the auction itself (cf. B.V. and C.III.4.). The registration is free of charge. Scope of the Utilisation The Operator shall provide to the Users an online auction platform which is subdivided into various categories. When an auction has ended, the Operator shall send the data required to contact the other party to the seller and the buyer by e-mail so that the contract concluded between the Users can be transacted.
